239a Commission. 6 June 1444. [Mouter]. Addressed to Richard, prior of St Thomas the Martyr by Stafford, Thomas Chesterfeld, clerk , James Leveson , Humphrey Cotes , Thomas Everdon , and Nicholas Assheby , quorum two, of whom James or Thomas Everdon are to be one. Inquire, as by writ de idiota inquirenda, by personal examination and if necessary by a jury, whether she is an idiot, if so for how long she has been, whether she has lucid intervals, and who has occupied her lands meanwhile and received the profits. Inquire as to the value, tenure, and service of any lands alienated by her during her idiocy, and as to her next heir. With mandate for the return of the inquest to Chancery, and note that the sheriff has been ordered to summon a jury. [Dorse:] Prior Richard, James Leveson , and Nicholas Assheby certify the king in Chancery that by virtue of the above letters patent they went in person to Thomasia at Stafford on 29 June 1444 and examined her as best they could to determine her state, by which it appears to them that she is an idiot and of unsound mind and has long been incapable of governing herself or her lands. They thought it necessary to inquire carefully concerning this and all other matters specified above by a jury, and the resulting inquisition is attached.

Since 3 May 1419 she has continually been an idiot and incapable of governing herself or her lands, but it is not known how she became an idiot. Philip Chetewynde , her late son, occupied her lands and tenements and received the issues from the time of her idiocy until his death on 20 May last, by colour of a charter made by Thomasia in her idiocy. Hence none of the lands and tenements passed into Philip’s possession by this charter. Eleanor, Philip’s late wife, occupied the lands and received the issues from 20 May until this inquisition, by what title it is not known.
Her next heir is her kinsman Humphrey Hexstall , the son of Margaret, the daughter of William, the son of Margaret, the sister of William Froddesham , Thomasia’s father. [Head:] Delivered to court on 25 November.
