JOHN, LATE EARL OF ARUNDEL

369 Commission. 30 June 1440. [Bate]. Addressed to John Wynnesbury , Richard Horde , Thomas Hopton , Hugh Cresset , the sheriff, and escheator. Regarding CIPM XXIV, no. 371, an inquisition taken in 1435. Order to at least two of them to inquire as que plura. The sheriff is to empanel a jury [CPR 1436–41, p. 449].

He held more lands and tenements, as following, than specified in the inquisition taken after his death and returned to Chancery. Shrawardine, the castle, vill, and manor. The castle and site of the manor are worth nothing yearly, but the manor and vill are worth 24 marks yearly, viz., 12 marks service rent, payable at the four usual terms of the year equally. In the manor, there are 100 a. arable, each acre worth 8d. yearly; 80 a. meadow, each acre worth 12d. yearly; and 160 a. pasture, each acre worth 1d. yearly. Tibberton, the hamlet, member of the manor of Dawley Magna. The site of the hamlet is worth nothing yearly, but the hamlet is worth 46s. 8d. yearly, viz., 30s. service rent, payable as above; 10 a. meadow, each acre worth 12d. yearly; and 80 a. pasture, each acre worth 1d. yearly. Childs Ercall, the manor. The manorial site is worth nothing yearly, but the manor is worth 100s. yearly, viz., £3 service rent, payable as above; 60 a. arable, each acre worth 4d. yearly; and 20 a. meadow, each acre worth 12d. yearly. The castle, vill, hamlet, and manors are held of the king as a knight’s fee. He died seised in demesne as of fee tail of the castle, vill, and manor of Shrawardine, and the hamlet of Tibberton because Richard, late earl of Arundel , was formerly seised in demesne as of fee of them, and also of the castles, vills, and manors of Clun and Oswestry, and the manors of Ruyton-XI-Towns, Bucknell, Stretton, The Heath, Westhope, Cound, Acton Round, Wroxeter, Upton Magna, Dawley Magna, Alcaston, and Hints (Hyntes), among other things, as specified in the inquisition taken after John’s death. Thus seised, by a fine levied at Westminster on the octave of Trinity 1347 [CP 25/1/287/43, no. 401], between Richard, late earl, querent, and John de Alresford and John Sprot, chaplain, deforciants, regarding, among other things, all the above castles, vills, and manors, Richard recognised them to be the right of John Sprot, as held by John and John by grant of the earl. For that recognition, John and John granted them to Richard, late earl , for life, with remainder to the heirs male of Richard, of the body of Eleanor, daughter of Henry de Lancastr, senior, late earl of Lancaster . The fine was shown to the jurors. Richard was thus seised and, after he took her as his wife, had issue with Eleanor: Joan, late countess of Hereford , Richard, Alice, late countess of Kent , John, and Thomas, late archbishop of Canterbury . Richard, late earl, afterwards died seised in demesne as of free tenement and the castles, vills, and manors remained to Richard as son and heir male of Richard of the body of Eleanor. Richard son of Richard had issue: Thomas, late earl of Arundel, and he died seised in demesne as of fee tail. The castles etc. descended to Thomas, late earl, as son and heir male of Richard son of Richard, by virtue of the fine. Thomas, late earl, died seised in demesne in fee tail in form aforesaid without heir male of his body. The castles etc. descended to John Arundell, chevalier , as kin and heir male of Thomas, late earl, as son of John son of John son of Richard of the body of Eleanor. John son of Richard was brother of Richard son of Richard of the body of Eleanor. Richard son of Richard was the father of Thomas, late earl. John Arundell, chevalier , was thus seised of the castles etc. in demesne as of fee tail in form aforesaid, and he died so seised. The castles etc. descended to John, late earl of Arundel , as son and heir male of John Arundell, chevalier, and John, late earl of Arundel , also died seised in demesne as of fee tail. After his death, the castle, vill, and manor of Shrawardine and the hamlet of Tibberton, among other castles, vills, and manors, should descend to William, present earl of Arundel , as brother and heir male of John, late earl, because John, late earl, died without heir male of his body. John, late earl, was seised of the manor of Childs Ercall in demesne as of fee, and this manor should descend to William present earl of Arundel, as brother and heir of John, late earl, also because John died without heir of his body. John Richard, clerk , and William Brygge have taken the issues of the castle, vill, and manor of Shrawardine, the manor of Childs Ercall, and the hamlet of Tibberton since the late earl’s death until the day of this inquisition, title unknown.

He died on 20 June 1436 [sic]. William, present earl of Arundel , is his brother and next male heir, and aged 23 and more.He held no more lands or tenements except those specified in this inquisition. [Head:] Delivered to court on 7 October 1440. [Dorse:] Memorandum that on 22 October 1440, the said William, earl , personally appeared in the king’s Chancery and sued for livery of the castle etc. [in ms]. Present were the chancellor, the earl of Salisbury , Hungerford, and the chief justice and others etc. [in ms].
