He held no lands or tenements in demesne as of fee or service of the king, or any other. Long before his death, he granted, among other things, all his lands and tenements, rents, reversions, and services, that he had in the vills and fields of Brookhampton, Combrooke, Kineton, Little Kineton, Butlers Marston, Compton Verney, Coventry, Binley, Newbold on Avon, and Willoughby, to Thomas le Strange, esquire , Nicholas Ledewych, esquire , Robert Boishell , William Derset , John Wyllenhale , Geoffrey Wyllenhale , Richard Wyllenhale , Robert Porter , William Halforde , and Thomas Derset , and their heirs and assigns. The grant was made by charter, dated at Brookhampton on 25 July 1423, shown to the jurors. He was described as Hugh Dalby . He afterwards made his will in these words. ‘This tripartite indenture, made at Brookhampton on 23 February 1435, bears witness that this is the last will of me, Hugh Dalby of Brookhampton. I beseech each and every person who was enfeoffed, to my use, by me or any other, with each and every of my lands and tenements, rents, reversions, and services, and my executors, to complete this my last will faithfully in all things for the sake of charity. I will that the feoffees enfeoff Richard Dalby , my son, in each and every of my lands and tenements, rents, reversions, and services in the vills and fields of Brookhampton, Combrooke, Kineton, Little Kineton, Butlers Marston, and Binley, to hold to him and his heirs and assigns. I will that the feoffees enfeoff John Dalby , my son, with each and every of my lands and tenements, rents, reversions, and services in the vills and fields of Newbold on Avon, to hold to him and the heirs of his body, with successive remainders to Richard Dalby and the heirs of his body; to Hugh Dalby , my son, and the heirs of his body; and to Agnes and Margaret, my daughters, and the heirs of their bodies, with reversion to the right heirs of me, Hugh Dalby . I will that my feoffees enfeoff Hugh Dalby , my son, with all my lands and tenements, rents, reversions, and services in the vills and fields of Willoughby, to hold to him and the heirs of his body, with successive remainders to John Dalby and the heirs of his body; to Richard Dalby , my son, and the heirs of his body; and to Agnes and Margaret, my daughters, and the heirs of their bodies, with reversion to the right heirs of me, Hugh Dalby . In witness of which, I have placed my seal to this tripartite indenture. Witnessed by Edmund Dalby , Robert Deken , John Raddewey , Thomas Basse , Richard Dawe , and others.’ The feoffees enfeoffed Richard Dalby and Hugh Dalby , as contained in the will. Hugh, father of Richard and Hugh, afterwards quitclaimed to them, for him and his heirs, and all others for him or in his name, all right, title, and claim that he had in the lands and tenements, rents, reversions, and services in the vills and fields of Brookhampton, Kineton, Little Kineton, Combrooke, Butlers Marston, Binley, and Willoughby. The release was dated at Brookhampton on 14 March 1435, sealed with the seal of Hugh, father, and witnessed by John Raddewey of Butlers Marston, Robert Deken , Thomas Basse , John Bonde , John Turner , and others. The date is recorded in ms as ‘Tuesday the feast of St James the Apostle 1 Henry VI’. This translates as 25 July 1423, yet the feast of St James in this year fell on a Sunday. Richard Dalby afterwards enfeoffed Edmund Dalby , John Raddewey , and Thomas Basse with all the lands and tenements that he had by the above enfeoffment by Thomas le Strange , Nicholas Ledewych , and the others. Edmund Dalby , John Raddewey , and Thomas Basse afterwards enfeoffed Richard Dalby and Joan his wife by charter in these words. ‘Let present and future know that we, Edmund Dalby of Pillerton Hersey or Pillerton Priors (Pyllarton), John Raddewey of Butlers Marston, and Thomas Basse demise, deliver and with this, our indented charter, confirm to Richard Dalby and Joan his wife all those lands and tenements, rents, reversions, and services in the vills and fields of Brookhampton, Combrooke, Kineton, Little Kineton, Butlers Marston, and Binley, that we lately had by enfeoffment of Richard Dalby , to hold to them and the heirs of Richard’s body, with successive remainders to John Dalby , brother of Richard, and the heirs of his body; to Hugh Dalby , brother of Richard, and the heirs of his body; to Agnes and Margaret, daughters of Hugh, and the heirs of their bodies; and to the right heirs of Hugh, father of Richard. In witness of which, we placed our seals. Witnessed by Robert Deken , Richard Dawe , Thomas Furn , John Bonde , and others. Dated at Brookhampton on 1 December 1435.’ The lands and tenements held by Richard Dalby in Brookhampton are held of the lord John Grey , son of Reynold Grey of Ruthin, as of the manor of Kineton, by suit of court twice. Of whom the other lands and tenements are held is unknown.
He died on 27 January 1439. John Dalby , his son and next heir, is aged 32 years and more.
